sgat.me — marketing website for the Tales & Tails app

These Terms govern use of the marketing website. Use of the Tales & Tails app itself (iOS, Android, web), account creation and the Nine Tails subscription are governed by separate App Terms of Service, which you accept when registering in the app.

1. General#

1.1. The site is owned and operated by Hombosh Tomash Zoltanovych (individual entrepreneur, tax ID 3461006118, address: 15 Lomonosova St., Vynohradiv, Zakarpattia Oblast, 90300, Ukraine) — “we”, “the Company”.

1.2. “You”, “User” — any person who opens the site or any of its pages.

1.3. By opening the site you confirm that you have read these Terms and agree to be bound by them. If you disagree, please stop using the site.

1.4. The site is informational and promotional only. It describes the Tales & Tails app and links to where it can be downloaded.

1.5. The address in clause 1.1 is published only to meet legal disclosure requirements and is intended solely for official correspondence. Using it to cause harm, to harass or threaten anyone, for fraud, or for any other unlawful purpose is prohibited and entails liability under the law of Ukraine.

2. What the site is not#

2.1. The site is not a public offer within the meaning of Art. 641 of the Civil Code of Ukraine. Information about features, pricing and timelines is indicative.

2.2. The site does not provide reading-diary services — the app does, under its own terms.

2.3. The site is not a source of professional advice (legal, financial, medical or educational).

2.4. The Nine Tails plan price — UAH 99 per month or UAH 799 per year — and the scope of the free plan shown on the site are current as of the effective date and may change. The price binding on you is the one displayed in the web app at the moment you subscribe.

3. Acceptable use#

3.1. You may freely browse the site, share links to it and quote its materials with attribution.

3.2. You must not:

• copy, reproduce or distribute substantial portions of the site's content for commercial purposes without our written consent;
• use automated tools (scrapers, bots, crawlers) in a way that imposes excessive load or circumvents technical restrictions, except well-known search engine crawlers that respect robots.txt;
• attempt to gain unauthorised access to the site, servers or related infrastructure, or conduct penetration testing without our prior written consent;
• modify, decompile or create derivative works from the site's code;
• use the site to distribute malicious code, spam or unlawful content;
• remove or alter copyright notices, trade marks or other proprietary notices.

3.3. We reserve the right to block access from any IP address that breaches clause 3.2, without notice.

4. Intellectual property#

4.1. All rights in the site and its content belong to the Company or its licensors, including:

• the Tales & Tails name and word mark, logos and wordmarks (in all variations);
• the nine-tailed kitsune fox character — the keeper of stories — and all derivative illustrations and animations;
• the design, layout, colour palette, typography, icons, text, images, video and code of the site.

4.2. These Terms grant you no licence to use our trade marks, trade dress or character, other than fair quotation and referential use.

4.3. Book titles, author names, cover images and other works that may appear in demonstration screenshots belong to their respective rights holders and are shown for illustrative purposes only.

4.4. If you believe material on the site infringes your rights, send a reasoned notice to legal@sgat.me identifying the work, the basis of your rights, the specific URL and your contact details. We will review it within 10 business days.

5. Third-party links#

5.1. The site links to the App Store (Apple), Google Play (Google) and other external resources. We do not control their content, terms or policies.

5.2. The app is downloaded from the App Store or Google Play under the rules of the relevant app store. The Nine Tails subscription is purchased in the web app through the payment operator WayForPay under §6 of the App Terms of Use; refunds for the subscription are governed by those App Terms of Use, not by Apple's or Google's policies.

5.3. The Company is not responsible for the availability, content or consequences of using third-party resources.

6. Availability#

6.1. We aim to keep the site running, but do not guarantee uninterrupted or error-free availability.

6.2. We may change, suspend or discontinue the site or any part of it at any time, in whole or in part, without prior notice and without liability to you.

7. Disclaimer of warranties#

7.1. The site is provided “as is” and “as available”.

7.2. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, completeness and currency of information.

7.3. Nothing in this section limits your consumer rights under mandatory provisions of Ukrainian law or the law of your country of residence.

8. Limitation of liability#

8.1. To the maximum extent permitted by law, the Company is not liable for indirect, incidental or consequential damages, lost profits, or loss of data or reputation arising from use of, or inability to use, the site.

8.2. The Company's aggregate liability for all claims relating to this site is limited to UAH 1,000.

8.3. Clauses 8.1–8.2 do not apply to wilful misconduct, gross negligence, death or personal injury, or where such limitation is prohibited by law.

9. Personal data#

Processing of personal data on the site is described in the Privacy Policy, which forms an integral part of these Terms.

10. Changes to these Terms#

10.1. We may amend these Terms. The current version is always available at sgat.me/terms with its date.

10.2. Changes take effect upon publication. Continued use of the site after publication constitutes acceptance of the new version.

11. Governing law and disputes#

11.1. These Terms are governed by the laws of Ukraine, excluding conflict-of-law rules.

11.2. Disputes are to be resolved by negotiation. Send claims to legal@sgat.me; we will respond within 30 days.

11.3. Failing agreement, disputes are subject to the courts of Ukraine at the Company's location, except where mandatory consumer protection law entitles you to bring proceedings in the courts of your place of residence — that right is preserved.

12. Final provisions#

12.1. If any provision is held invalid, the remaining provisions remain in force.

12.2. Our failure to exercise a right is not a waiver of it.

12.3. These Terms are the entire agreement between you and the Company regarding the website and do not replace the App Terms of Service.
